USA Spouse Visa Work Permit Requirements
For F2 Visa (Student Spouse):
- Cannot legally work in the U.S.
- Can study part-time or full-time (in some cases)
- Must apply separately and be tied to the F1 holder's status
For H4 Visa (Worker Spouse):
- Must apply for Employment Authorization Document (EAD) to work
- EAD is only available if the H1B holder is on the path to green card (approved I-140)
- Without EAD, the spouse can reside in the U.S. but cannot work legally
Required Documents (General):
- Must be legally married or in a common-law partnership with the primary applicant
- Primary applicant must hold a valid Canadian study or work permit
